In 2007 the Cultus Lake Waterpark commenced a $6 million dollar expansion with the approval of the Cultus Lake Park Board. Some local members of the Cultus Lake community challenged the actions of the Park Board and brought a court action to stop the construction of the expansion, which was already well underway. We successfully represented the Waterpark at the British Columbia Supreme Court who ultimately found that the while the Park Board initially breached its duty of procedural fairness, this was largely compensated for by their subsequent actions. The court did not order the construction to stop and the new expansion is being enjoyed by thousands of children. Click here for the court’s decision.
